Terms and Conditions
Prior to beginning any exercise program, you must consult with your physician. By registering with Synergy ProTraining, you certify that you have received consent from your physician to participate in the programs, workouts, and exercises to be provided by Synergy ProTraining or any of its associates. Any application of the recommended advice from any of our services is at your own sole risk, and your discretion. Responsibility of any injuries or other adverse effects resulting from the application of any of the information provided from any of our services is hereby expressly disclaimed.
In addition, you agree to the following terms and conditions. The terms and conditions of this Agreement may be modified at any time by Synergy ProTraining. Any amendments or modifications will be distributed to the athletes and customers of Synergy ProTraining. Your continued usage, after such changes are posted, constitutes acceptance of each revised provision of the Agreement. By electronically signing this agreement, you agree to the terms of this Agreement or any revised Agreement, unless proper written notification of such discrepancies is otherwise submitted to Synergy ProTraining.
Payment Terms
Synergy ProTraining`s service is a month by month service, which you can cancel with a thirty (30) days written notice. No notice will automatically renew for 30 days each month. You agree to pay the required monthly fee for usage of our services. Each month is to be paid in advance. Furthermore, you agree to autorize Synergy ProTraining to process the credit card payment for the monthly amount associated with the coaching package you are signing up with. Synergy ProTraining will process your credit card prior to the first of each month for this agreed upon amount until notified in writing. Accepting our terms of use indicates that you understand that you will be responsible for payment until cancelation.
Disclaimer
Synergy ProTraining requires that you consult with your physician before following any training instructions you receive from Synergy ProTraining. Synergy ProTraining is not a licensed medical care provider and represents that it has no expertise in diagnosing, examining, or treating medical conditions of any kind. Synergy ProTraining is not responsible for any health problems that may result from training programs, products, or events you learn about through Synergy ProTraining or any of its associates. You should understand that when participating in any exercise or exercise program, there is the possibility of physical injury and/or death.
If you engage in any exercise program you receive through Synergy ProTraining, you agree that you do so at your own risk. You agree to indemnify and hold harmless Synergy ProTraining and all of its associates for any loss, liability, claim, damage, and expenses (including reasonable attorneys' fees) arising from or in connection with your use of the information or services you receive through Synergy ProTraining.
Synergy ProTraining is not responsible for the accuracy, reliability, effectiveness, or correct use of information you receive through the ColoradoPremierTraining.com web site or any of Synergy ProTraining’s affiliates, or for any health problems that may result from training programs, products, or events you learn about through Synergy ProTraining. Synergy ProTraining does not certify content or endorse any information supplied by other companies unless otherwise stated.
Governing Law and Jurisdiction
Any dispute arising out of or related to these Terms and Conditions or the sales transaction between Synergy ProTraining and you shall be governed by the laws of Germany, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. Synergy ProTraining and you consent to the exclusive jurisdiction and the exclusive venue of the state and/or federal courts located in Germany to resolve any dispute between them related hereto.
Limitation of Liability in All Circumstances
Synergy ProTraining is neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to Synergy ProTraining, its website, or related services and/or content. Your sole remedy for dissatisfaction with Synergy ProTraining is to provide thirty (30) days written notification and discontinue usage of its services and/or website.
Severability
If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable German law.
